This is a decision by the Council of State in relation to a complaint from the Ternano Orvietano ATC, which intended to annul the part of the Umbria Region regulation defining compensation for damaged farmers.
The ATC's appeal had already been rejected at first instance, and now it's happened again. This sets a dangerous precedent, and some regions are already trying to figure out what will happen after this rejected appeal.
The first to voice its concern was the Abruzzo ATC, the Avezzano ATC, which calculated that hunters in the region would find themselves in the unfortunate position of paying higher registration fees for both individual and group wild boar hunts. A similar principle could be extended to all selective control hunters, if there weren't at least some guarantee of reducing the number of ungulates.
The Constitutional Court ruling, however, specifies that the contribution cannot be requested from the hunting community, and this can only occur if the portion of funding allocated to the Region is not properly used.
It is clear that in this entire mechanism, a factor of capital importance is the ability to effectively achieve good containment of wild ungulates.
