The Marche Regional Administrative Court (TAR) rejected, with precautionary order 321/2020, a precautionary application that also called for the suspension of the 2020/21 hunting calendar. This information is contained in a press release jointly produced by Arcicaccia, Liberacaccia, Federcaccia, and Enalcaccia, which had filed an appearance in court against the appeal.
The press release states that "the Marche Regional Administrative Court, fully accepting the hunting association's objections, deemed the precautionary grounds raised by the environmentalist association as the basis for the suspension request to be non-existent, preliminarily noting the lack of a prima facie case (the appearance of a valid legal basis in the appeal) even before the pericolum in mora, that is, the possibility that the contested provision could cause irreparable damage to the protected interest."
The press release itself states that the TAR considered that the Marche Region had substantially respected the rationale of the contested regulations in drafting the Hunting Calendar, finally noting that the national opinions expressed by ISPRA are derogable in the exercise of regional administrative power in wildlife and hunting matters.
For the aforementioned hunting associations, the regular continuity and proper functioning of the wildlife sector was established, given that there was a risk of being paralyzed by this action undertaken at the TAR.
