The Government has raised concerns about the unconstitutionality of the Piedmont regional law on hunting. The interpretation immediately given by Federcaccia and highlighted to the Prime Minister's Office and the Piedmont Region is confirmed.
Rome, August 9, 2018 – The Council of Ministers, which met yesterday evening, upon the proposal of the Minister for Regional Affairs and Local Authorities, Erika Stefani, resolved to challenge Piedmont Regional Law No. 5 of June 19, 2018, on "Protection of Wildlife and Wildlife-Hunting Management." The law states that certain provisions, regarding hunting on private land and the hunting calendar, exceed regional jurisdiction and encroach on matters of civil law and environmental protection, reserved to state legislation by Article 117, paragraph 2, letters l) and s), of the Constitution. This upholds the arguments of unconstitutionality that the Piedmont regional law had raised, both before and after its approval, and about which Federcaccia Nazionale and Federcaccia Piemonte had warned the Government and the Region.
With a certified email dated June 6th – prior to the discussion and approval of the measure – Federcaccia sent to the President of the Regional Council and the President of the Regional Council of the Piedmont Region, to the President of the Council of Ministers, to the Minister of the Environment and Protection of the Territory and the Sea and to the Minister of Agricultural, Food and Forestry Policies, a substantial technical-legal document in which the numerous aspects of unconstitutionality of the Regional Bill of 1.12.2015 n. 182 were highlighted.Wildlife protection and wildlife-hunting managementOn that occasion, Federcaccia expressed the hope that the Piedmont Regional Council would amend the bill in question to bring it into compliance with constitutional principles and formally invited the Government to monitor the work of the Regional Council itself in a matter that falls exclusively within the legislative competence of the State.
Following the approval of the bill, largely unchanged, the Federation's commitment continued. Through Federcaccia Piemonte President Bruno Morena, the Federation continued its efforts to raise awareness among government officials, particularly Agriculture Minister Centinaio and Minister Stefani. President Morena met with Minister Stefani on Friday last week, personally providing her with further information on the bill's text and receiving assurances of her interest in the matter.
But let's also remember the appeal filed by Attorney Campanile, president of Federcaccia Liguria, on behalf of the Coordination of Ligurian Hunting Associations.
We can only express our appreciation and thanks for the evident and concrete attention that was paid to our arguments and which led to the decision to challenge law no. 5 of 19 June 2018, underlining how the choice to proceed along the path of confrontation supported by technical and legal arguments is the one that leads to the best results in seeing one's reasons recognized.
